Escalating fights force coney island restaurant to alter hours

Early in the morning on Jan. 11, the usual late night crowd gathered at Luca’s 24-hour Coney Island restaurant in Ypsilanti Township.

Before long, a fight broke out between two groups of customers, something that's not uncommon at the restaurant at 2469 Washtenaw Ave. As they had 225 times over the last four and a half years, police responded.

But this time, one customer pulled out a gun and put it to the back of another customer's head, police said.

The victim ran into the kitchen, and the man next knocked a waitress to the ground and shoved the gun in her face, police said.

By the time Washtenaw County Sheriff’s deputies arrived, everyone at the restaurant except the victims had fled, but surveillance footage clearly showed the fight from multiple angles. A week later, sheriff's deputies arrested 32-year-old Ronjour Jacobs of Ann Arbor on felonious assault charges.

Another man who pulled out a gun during the fight has not been identified by police.

Jacobs faces three charges of assault with a dangerous weapon as well as charges of assault and battery, possession of a firearm during the commission of a felony and brandishing a firearm. He is held on $100,000 cash bond. A pretrial hearing is set for March 4.

The incident led Ypsilanti Township and the Washtenaw County Sheriff's Office to ask the owners to close the restaurant between 12 a.m. and 5 a.m. and threaten legal action if it didn't happen by the end of the week. The township had made such requests previously. Luca's owner, George Gsokas, had complied with the requests in the past but eventually went back to operating in the early morning hours each time.

At their Monday night meeting, the Ypsilanti Township trustrees re-authorized township staff to ask a Washtenaw County Circuit Court judge to declare the business a public nuisance and order it closed during that time period.

But Gsokas said on Wednesday he is willing to permanently close the restaurant between 12 a.m. and 6 a.m.

"I did my best as a business owner to have security, but I don’t want to risk it," Gsokas told AnnArbor.com. "I am a very peaceful person and I don’t want bad things to happen, not just in the restaurant, but in the whole world. I want to have peace.

"I try my best to make sure to have no trouble, but people coming from bars, they're kind of drunk and it's hard to deal with them. I make this decision to voluntarily close on the third shift."

The restaurant has closed during early morning hours due to similar issues several times in the past; most recently 18 months ago.

There have been 70 calls for service at Luca’s since it last closed during early morning hours in August of 2011, and 70 percent of those calls have come between 2 a.m. and 5 a.m. The incidents have included large fights, assault, credit card fraud, disorderly conduct, larceny and more. Neighbors behind Luca’s regularly complain about the noise, and police have made multiple driving under the influence and drug arrests.

Additionally, there have been many occasions when all the Sheriff’s Office's units were tied up at other incidents in the township and assistance was requested from police in Pittsfield Township, Ann Arbor, the city of Ypsilanti, Eastern Michigan University and the Michigan State Police.

“Needless to say, everything going on there is point-blank unacceptable,” Township attorney Doug Winters told the Board of Trustees at its Feb. 11 meeting.

On Feb. 11, township and police officials met with Gsokas and a representative of the Barbara Shipman Trust in Ann Arbor, which owns the building. It’s the fourth time the group has met in four years to discuss the problem.

“There are not enough police resources to police this place night after night, and we made it crystal clear the problems had to cease,” said Mike Radzik, director of the township’s office of community standards,

But after learning on Wednesday that Gsokas had agreed to close, Radzik said he was pleased to close the "negative chapter".

"I am very pleased that (Gsokas) has decided to modify the business hours in the best interest of his employees, customers and the public," Radzik said. "The (Shipman Trust) was instrumental in helping to facilitate this change at the township's request. I am convinced that they want to be a positive example on Washtenaw Avenue and a good neighbor to the residents who live nearby."

Luca’s hired security guards after the August 2011 meeting, but officials said it was often those security guards, along with a security guard at a neighboring business and homeowners on Brookside Lane behind the restaurant, who were calling the police.

Police have faced situations in which there were 50 and 60 people, and one or two deputies simply couldn’t handle the crowd, so backup had to be called.

“Then you have everyone scattering when the police arrive and the parking lot is chaotic with people trying to leave. After dealing with this for years the only viable solution is the building not being open during these hours,” Radzik said.

I'm a guy and attend EMU, and during finals last semester I went to study at Luca's late night...though nothing happened, I felt unsafe the entire time and didn't stay long. This doesn't surprise me at all.

and yes it was on the news for the surrounding areas to see, how embarrassing and not good for his business. it is not fair they are hard working people they do not deserve this. when those kids get community service, the judge should make them clean inside and out and make them do landscaping at Lucas they have no respect for peoples property let them clean it up and see how they feel after hard work if someone were to disrespect their work.

Here's the way I look at it. Maybe we should concentrate on stiffer penalties against those who choose to use weapons in the wrong way. 90 days in county (with many privileges) and two years probation is a joke!! Most of these multiple offenders eat that up like cereal in the morning. How about the moment you choose to reveal a weapon is an automatic 5 year PRISON sentence! In addition, if you choose to use a gun while committing a crime....its an automatic 20 year PRISON sentence!! It seems as if we have a modern day wild, wild, west in the streets. If you don't believe me watch the news or read this paper ( on-line)! Now there are a lot of good people still in this area that would NEVER get caught up in such mayham...it's the ones that choose to use force to settle differences or overpower the defenseless, that should be delt with accordingly, so the good people won't live in fear or have to consider purchasing guns ( most of whom have never owned a gun ) to feel safe in their own community. Please remember who we're considering here. These people choose to tote guns and aim them at defenseless ( unarmed ) people. This is THEIR choice. These are not people that want to ( or are ) making a positive difference in our community. So again, if they choose this path....punish them to the fullest!!! Let's start by making an example of people that add no value to our community!! I'm just saying!!

An awesome display of belligerence, aggressiveness and bad judgement, eh? President Obama and both of Michigan's U.S. Senators have vowed to stop gun violence in the nation: let them start with the crowd at Luca's. As we've been repeatedly told over the past 2 months: the problem is semi-automatics with large capacity magazines. So we can expect Obama & Co. to first ban such weapons and to then make Luca's a Gun Free Zone, with possession of large capacity magazines declared to be, uh, especially bad. That'll surely devastate dudes like Mr. Jacobs and the other guy shown holding what appears to be that kind of pistol. If everyone could be forced to limit themselves to 6-shot revolvers and 5-shot rifles, the world would be at peace. ;-)

From the video, it looks like two girls from different groups were arguing and then start fighting and the guys got defensive and started pulling the girls away from each other, but the guy with the red hat started pulling people off of the girl in the checkered jacket, but because of that the guy with the gun pointed it at the guy with the red hat and he ran off, leaving the girl in the checkered jacket alone on the floor. I'm amazed this fight was not only caught on security cameras, but AA.com spliced it all together. The internets.

Despite the video evidence, the liberal judges in the Washtenaw Circuit court will see how Mr. JaCobs is the victim here, and give him a 90 day jail sentence and 2 years probabtion. Someone who pulls a gun on a person, and puts it on thier head should be heading to State Prison for a very long time. I realize that people are innocent till proven guilty, and this is up to a jury, I just hope if he is convicted the Judge assigned to this case will have the ba*** to sentence this person properly!!!

Look at the number of police calls to that address over the years. Police react to crime as it happens, so how should they "solve" this issue? The next step is to have it declared a public nuisance, and I don't think the owner would like that.

Holy moley! This is insane! And it happens all the time (?) Parenthetically: trust me, you antigunners: (1) I'll bet my next paycheck that the dude with the semi-auto doesn't have a permit to carry it; (2) no person who has a CCW and is acting in accord with law would ever brandish his gun and so cavalierly wave it and point it like the dude in the video was doing. If/when the gun guy is caught and charged and (given the video "proof") convicted of something (probably after lots of plea bargaining), I hope the court system levies a stiff and meaningful punishment.

HB11 He may not have a ccw but he does have some type of permit. Just because a person has permit, licence, certification or whatever other type of paper that justifies what they have DOES NOT mean that it cant be misused. So the fact of someone having something such as a gun and using it in a manner in which you might not or in which you might think is not smart does not mean that he was not legally allowed to have it.

RCDC, you are clearly uninformed. CCW is a charge levied by law enforcement in MI. Here a CPL or concealed pistol license is issued ONLY after a background check, $150, and much bureaucracy. The laws are clearly noted when you get this license. So how does one "clearly" have a CCW? Yes Atlas, you are "spot on."

Yeah except they were all friends or associates with people involved in the altercation. You don't run away when your friend is about to get into a fight. You stay and try to stop it, which is what most people in that video were doing.

I thought the same thing about leaving when the fight started. I'm sure it felt unreal at the time, but I also can't imagine wanting a coney dog and fries after that.

Is it the hours? The location? Or the clientele? BW3 left downtown Ypsi years ago because of the fights - and now their business is booming south of I-94 that statement says it all - how cool was it that Ypsi had a BW3 downtown and how the city Could not keep it there?

The area of Ypsi township South of I-94 is much safer and better for business. Just like folks in denial such as yourself should realize Ann Arbor or Pittsfield township has it's bad areas as well.
